By accessing or using the TrueHire application, website, platform, or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use TrueHire.
1. Services
TrueHire provides paid data verification and background checking services, which may include, among others:
- contact-related verification, including whether a phone number or contact detail may be associated with a particular individual or identity;
- identity, employment, security, fraud prevention, compliance, or other background checks for lawful purposes; and
- other verification, screening, or data-checking services made available by TrueHire from time to time,
in each case subject to valid consent, lawful basis, and applicable laws.
2. Role of TrueHire
TrueHire is not a telecommunications provider, government authority, law enforcement agency, or official identity registry. Therefore, TrueHire cannot make reports, block numbers, suspend telecommunications services, correct operator records, or issue official clarification regarding any phone number or identity data.
TrueHire provides supporting information to help users obtain a general indication or overview based on available data. TrueHire does not provide any final, official, or legally binding determination regarding a person's identity, background, status, eligibility, conduct, or risk profile.
Where TrueHire processes personal data on behalf of a business user or organization, TrueHire acts as a Personal Data Processor, and the relevant business user or organization acts as the Personal Data Controller, unless otherwise agreed in writing.
3. User Responsibility
TrueHire processes data and information based on the instructions, requests, and representations provided by the user. TrueHire shall not be responsible for any access, use, request, submission, or transaction made through a user account by anyone other than the registered user, unless such access is caused by TrueHire's proven fault.
Users are responsible for maintaining the confidentiality and security of their TrueHire account, login credentials, password, API keys, and any other authentication method. Users agree not to share account access with unauthorized parties and must promptly notify TrueHire if they suspect any unauthorized access, misuse, or security breach.
4. Business Users and Consent Obligations
If the user is a company, organization, employer, recruiter, financial institution, or other business entity, the user represents and warrants that it has obtained valid, lawful, specific, informed, and documented consent from each individual whose data will be submitted to or verified through TrueHire.
The user is solely responsible for ensuring that any personal data submitted to TrueHire is collected, processed, and used in accordance with applicable laws and regulations, including Indonesian personal data protection laws and any other applicable sectoral regulations.
TrueHire provides its services based on the user's instructions and the consent obtained by the user from the relevant individual or data subject. TrueHire is not responsible for the user's failure to obtain proper consent, provide sufficient notice, maintain proper documentation, or comply with applicable data protection obligations.
5. Minimum Age and Legal Capacity
Users must be at least 18 years old and legally capable of entering into binding agreements under applicable law. By using TrueHire, you represent and warrant that you meet these requirements.
6. Privacy Notice
By using the TrueHire application or services, you acknowledge that you have read, understood, and agreed to TrueHire's Privacy Notice, which explains how personal data may be collected, used, processed, stored, disclosed, and protected.
7. Payment
Certain TrueHire features and services require payment. By purchasing or using any paid feature or service, you agree to pay all applicable fees, charges, taxes, and other amounts associated with your transaction.
Unless expressly stated otherwise in writing, all payments are final, non-cancellable, and non-refundable, including where verification results are unsuccessful, incomplete, unavailable, delayed, or inconclusive due to reasons outside TrueHire's control.
8. Permitted Use
You agree to use TrueHire only for lawful, legitimate, and authorized purposes. You must not use TrueHire:
- to submit false, misleading, incomplete, inaccurate, or unlawfully obtained data;
- to stalk, harass, threaten, intimidate, exploit, defame, discriminate against, or harm any person;
- to make unlawful employment, credit, insurance, security, or other decisions;
- to sell, resell, disclose, publish, distribute, scrape, or commercially exploit data obtained through TrueHire without authorization;
- to violate any person's privacy, personal data rights, reputation, or legal rights;
- to conduct surveillance, profiling, or monitoring without valid legal basis and consent;
- to bypass, interfere with, or compromise TrueHire's systems, security, access controls, or usage limits; or
- to use the services in any manner that violates applicable laws, regulations, or these Terms.
9. Data Retention
TrueHire will retain verification results and related user data only as necessary for the relevant service, legal, operational, audit, dispute resolution, compliance, or security purposes.
For subscription-based or recurring services, TrueHire may retain verification results for the purpose of providing automated checks, monitoring, historical access, reporting, or other subscription features, for as long as the user remains subscribed or as otherwise required or permitted by applicable law.
Where applicable, users may request deletion or restriction of certain data in accordance with TrueHire's Privacy Notice and applicable law.
10. Verification System
TrueHire implements reasonable security, verification, and access control measures to help verify users and reduce unauthorized or inaccurate use of the service.
However, TrueHire shall not be responsible for verification errors, failed checks, inaccurate submissions, unauthorized use, or incorrect results caused by user negligence, incomplete data, false information, lack of consent, account misuse, third-party system limitations, operator records, or other circumstances outside TrueHire's reasonable control.
11. Failed Verification
Verification of a user's NIK, phone number, identity, or other submitted data may fail or return no result due to several factors, including but not limited to:
- the individual being included in a protected, restricted, whitelisted, or special category, including public officials or certain stakeholders;
- the individual being included in a blacklist, watchlist, wanted-person list, or other restricted list;
- the phone number being registered by or on behalf of another person, including family members or representatives;
- the individual not having provided valid consent to the relevant provider, operator, institution, or data source;
- data not being updated, synchronized, available, accessible, or verifiable in the relevant third-party system;
- technical limitations, network issues, operator policies, regulatory restrictions, or data provider limitations; or
- other matters outside TrueHire's control.
In such cases, any fees already paid are non-refundable unless expressly stated otherwise in writing.
12. Confidentiality and Use of Verification Results
Users must keep all TrueHire verification results confidential and must not disclose, distribute, publish, sell, misuse, or use such results for unlawful purposes.
Users must not use verification results for discrimination, harassment, defamation, unlawful employment decisions, unlawful credit decisions, reputational harm, unauthorized profiling, or any purpose outside the lawful verification purpose disclosed to and consented by the relevant individual.
Users are solely responsible for any decision, action, or consequence arising from their use, interpretation, disclosure, or reliance on TrueHire verification results.
13. Accuracy and Third-Party Data
TrueHire verification results may not always be accurate, complete, current, or consistent with actual conditions. Results may differ from the current status of an individual, phone number, identity record, background information, or operator data due to factors outside TrueHire's control, including delayed updates, third-party database limitations, data entry errors, operator policies, system downtime, or incomplete source data.
TrueHire does not guarantee that any result is complete, up to date, error-free, or suitable as the sole basis for any decision. Users should conduct independent assessment and, where necessary, contact the relevant telecommunications operator, authority, institution, data source, or individual for further clarification.
14. No Professional Advice
TrueHire does not provide legal, employment, compliance, financial, credit, law enforcement, investigation, or risk management advice. Any information provided through TrueHire is for supporting verification purposes only and should not be treated as professional advice or a final decision-making basis.
15. Disclaimer
The TrueHire application and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by law, TrueHire disclaims all warranties, including warranties of accuracy, availability, reliability, merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, error-free operation, and compatibility with user systems or requirements.
16. Limitation of Liability
To the maximum extent permitted by applicable law, TrueHire shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic losses arising from or related to the use of, inability to use, reliance on, or interpretation of the TrueHire application or services.
This includes, without limitation, loss of profit, loss of business opportunity, reputational harm, employment-related claims, loss of data, regulatory exposure, third-party claims, or decisions made by users based on verification results.
TrueHire's total liability, if any, shall be limited to the amount paid by the user for the specific service giving rise to the claim, unless otherwise required by applicable law.
17. Suspension or Termination
TrueHire may suspend, restrict, or terminate a user's access to the application or services if TrueHire reasonably suspects that the user has violated these Terms, misused the services, submitted unlawful data, failed to obtain valid consent, compromised system security, or used the services in a manner that may expose TrueHire, any individual, or any third party to legal, regulatory, reputational, or security risk.
18. Changes to These Terms
TrueHire may amend, update, or modify these Terms from time to time. Any updated Terms will be made available through the application, website, or other appropriate communication channels.
Continued access to or use of TrueHire after the updated Terms become effective constitutes acceptance of the updated Terms.
19. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.
Any dispute arising from or in connection with these Terms shall be resolved in accordance with the dispute resolution mechanism determined by TrueHire or as otherwise agreed in writing between the parties.
